ChaloJi User Agreement

Foreword

Welcome to use our [ChaloJi] (hereinafter referred to as "this application"). This user agreement (hereinafter referred to as "this agreement") is a legal agreement between you (hereinafter referred to as "the User") and the application developer (hereinafter referred to as "we"), outlining your rights and obligations when using this application. Before using this application, please read all the terms of this agreement carefully. By downloading, installing, accessing, or using this application, you agree to be bound by this agreement. If you do not agree with any of the terms of this agreement, please do not download, install, or use this application.

1. Definition

  1. This Application: refers to the [ChaloJi] application and its related services developed by us and available on Google Play, including but not limited to the application, mobile version and related content, features and services.
  2. User: refers to an individual or entity that downloads, installs, accesses or uses the Application.
  3. We/Developer: refers to PT NUSABYTE TECHNOLOGIES INDONESIA, which is responsible for the development, operation and maintenance of this application
  4. Google Play: refers to the application distribution platform operated by Google, through which the application is provided to users for download and use.

2. Age limit and eligibility for use

2.1. Age requirements

You must be at least [18] years old to use this application. If you are a minor, you must use this application with the guidance and consent of your parents or legal guardians. We are committed to protecting children's safety and strictly adhere to Google Play's 'Child Safety Standards' policy. For minor users, we will implement additional protective measures, including but not limited to restricting access to certain features and enhancing content review.

2.2. Qualification of use

When using this Application, you guarantee that all registration information and materials provided are true, accurate, complete and updated in a timely manner. If the information provided by you is false, misleading or incomplete, we have the right to suspend or terminate your account and refuse you to use all or part of the functions of this Application.

3. Child Sexual Abuse and Exploitation (CSAE) Policy

3.1.       Child Safety Standards for ChaloJi

3.1.1.  Introduction

ChaloJi, operated and published by PT NUSABYTE TECHNOLOGIES INDONESIA, is committed to providing a safe, healthy, and strictly regulated communication environment for all users.

This Child Safety Standards document is publicly available and outlines our zero-tolerance policy toward Child Sexual Abuse and Exploitation (CSAE) in compliance with Google Play’s Child Safety Standards Policy.

These standards apply to all users and all content on ChaloJi.

3.1.2.  Zero-Tolerance Policy Toward CSAE
ChaloJi is committed to protecting the safety and rights of minors and takes the strictest measures to prohibit any form of child sexual abuse and sexual exploitation (CSAE). Users are strictly prohibited from engaging in the following activities, including but not limited to:

  1. Creating, uploading, disseminating, or trading any pornographic or sexually explicit content involving minors;
  2. Exposing minors to any form of sexual enticement, inducement, coercion, or manipulation;
  3. Soliciting, attempting to obtain, or trading nude images or sensitive personal information of minors;
  4. Conducting sexually suggestive conversations, role-playing, or any other inappropriate interactions with minors;
  5. Any attempt to induce or entice minors.

Any violation of the above regulations will be considered a serious breach, and we will not tolerate it. We will report the relevant content and information to law enforcement agencies in accordance with the law.

3.1.3.  Protection of Minors

      Age Restriction

a.     ChaloJi is strictly for adults aged 18+.

b.     We enforce age verification and promptly remove any minor accounts.

      Content Review

We utilize a combination of automated detection and human moderation to review:

a.     Live video content

b.     Text chats

c.      User-uploaded media files

d.     Any behavior that may indicate minor involvement

High-risk or suspicious content is immediately removed or escalated.

      Reporting Mechanisms

a.     Users can report:

b.     CSAE-related content

c.      Suspected minor presence

d.     Grooming or inappropriate behavior toward minors

e.     Serious reports are prioritized and reviewed within 24 hours.

3.1.4. Prohibited Content and Behavior

      Sexual Content Involving Minors

Strictly prohibited:

a.     Nude or sexualized images or videos of minors

b.     AI-generated or manipulated sexualized images depicting minors

c.      Textual descriptions, fantasies, or role-play involving minors

      High-Risk Behavior Toward Minors

Prohibited activities:

a.     Soliciting minors for images or personal data

b.     Offering gifts, money, or virtual items to lure minors

c.      Impersonating minors for inappropriate interactions

      Other Illegal Activities

Prohibited:

a.     Violating child protection laws

b.     Collecting minor data without consent

c.      Any content that jeopardizes child safety

3.1.5. Enforcement

ChaloJi enforces a strict penalty system:

a.     Immediate content removal

b.     Temporary or permanent account suspension

c.      Device bans

d.     Reporting CSAE cases to law enforcement

e.     We reserve the right to take legal actions against violators.

3.1.6. Developer Statement

PT NUSABYTE TECHNOLOGIES INDONESIA is dedicated to maintaining and publicly updating this Child Safety Standards document to comply with:

a.     Google Play Child Safety Standards Policy

b.     Applicable child protection laws and regulations

We will continue improving ChaloJi’s safety measures to ensure a trustworthy and secure environment for all users.

3.2.Age Restriction Statement

This service is only available to users aged 18 and over. We prohibit providing any services to children under the age of 13, and we will proactively delete their accounts if we discover such cases

nor do we intentionally collect any personal information from them. If you are under the age of 13, please stop using this service immediately.

If we have unknowingly collected personal information from children under the age of 13, we will delete it immediately in accordance with applicable laws.

3.3. Protection of personal information of children (under 13 years old)

We strictly comply with applicable laws (including the Children's Online Privacy Protection Act (COPPA)) regarding the protection of children's privacy and take the following measures when processing children's information:

  1. No Unsolicited Collection

We do not knowingly collect personal information from children under the age of 13, including account information, contact details, device information, etc.

  1. No Targeted Content Display

This service does not contain content, advertisements, or behavioral guidance targeted at children, and will not attract or target users under the age of 13 in any way.

  1. Parents'/Guardians' Rights

If a parent or guardian believes that their child under the age of 13 has submitted personal information to us, they can contact us through the contact information provided in this Privacy Policy. We will promptly delete the relevant data after verifying the identity.

3.4. Parental and Guardian Responsibilities

Guardians should guide minors in the proper use of online services and strengthen their awareness of protection. If guardians discover any inappropriate behavior or data submissions by minors on this service, please contact us immediately.

4. Minor Personal Information Protection Provisions

We place great importance on the protection of minors' (referring to individuals under the age of 18 or those who have not reached the legal age of majority according to the laws of their jurisdiction) personal information. We strictly adhere to relevant laws and regulations, including COPPA (Children's Online Privacy Protection Act) and GDPR-K (the children's provisions of the EU General Data Protection Regulation), and have implemented the following measures to effectively safeguard the personal information of minors:

4.1. Restrictions on Collection of Minor Data
We do not provide services to minors under the age of 18 (or the legal age of majority in the relevant jurisdiction). We do not knowingly collect, store, or process any personal information from such users, including but not limited to their name, address, email address, contact information, device identifiers, location data, or any other information that can be used to identify them.

4.2. Measures Regarding Illegal Data Processing
If we discover or receive confirmation that a user under the age of 18 has provided personal information, we will immediately take measures including but not limited to the following:
a. Promptly delete the relevant data, ensuring its complete removal from servers and databases;
b. Block the user from further access to and use of the application;
c. Send an account closure notification to the user, clearly informing them that their data has been deleted;
d. Prohibit the user from registering again to prevent subsequent submission of personal information.

4.3. Minor Reporting Mechanism

If you encounter a user suspected of being a minor while using our services, please retain relevant evidence and report it to us through the application's customer service email or complaint channel. We will complete verification and processing within 72 hours of receiving the report and notify you of the outcome via email.

If you are a parent or guardian and become aware that a minor under your care is using our application, please contact us immediately through the customer support email or complaint channel. We will complete user verification within 24 hours and take necessary measures, with the results provided via email. We also fully support guardians in deleting or uninstalling the application themselves.

Parents or legal guardians are responsible for supervising and managing the minor's use of [ChaloJi]. If a minor provides false information claiming to have reached the legal age of majority, you will bear full responsibility for any consequences arising therefrom. We strongly advise parents and guardians to educate their children about the importance of online safety and to monitor their online activities to ensure compliance with our policies and applicable laws and regulations.

5. Prohibited user behavior content

5.1 Illegal and harmful content

       Illegal activities: The use of services for illegal activities (such as fraud, money laundering, terrorism, human trafficking) is prohibited.

       Hate and violence: Posting content that is racist, religiously hateful, inciting violence or glorifying self-harm.

       Adult content: Unauthorized distribution of pornographic, obscene or child sexual exploitation material (comply with COPPA, GDPR, etc.).

       False information: the dissemination of rumors, the fabrication of news or the manipulation of elections.

5.2. Infringement of the rights of others

       Intellectual property infringement: Unauthorized uploading of pirated software, film and television, music or patent/trademark infringement.

       Privacy invasion: disclosure of other people's privacy (such as addresses, phone numbers, medical records) or unauthorized candid photography.

       Infringement of personality rights: defamation, insult, human flesh search or malicious tampering with the content of images.

5.3 Platform abuse and security

       Abuse of automation tools: Using crawlers, robots, and scripts to grab data or register accounts without permission.

       System interference: interference or disruption of services or servers or networks connected to services, cracking API restrictions, etc.

       False identity: Falsifying identity information, impersonating someone else (such as a government agency, celebrity) or entity relationship (this includes pretending to be a minor (if you are not a minor).

5.4. User experience damage

       Spam: Sending ads, spam, phishing links or repetitive irrelevant content (such as screen brushing).

       Malware: Uploads viruses, ransomware, spyware, or induces downloads of harmful files.

       Inducement: inducing clicks/downloads through rewards (e.g. "click to win" scams).

5.5 Transactions and Business Conduct

       Fraudulent transactions: false sales, forged payment vouchers or abuse of refund policies.

       Black market transactions: account resale or virtual currency cash-out.

       Unauthorized commercial use: Making money from non-commercial licensing services (such as reselling API access).

6. User content and behavior norms

6.1. User-generated content

[ChaloJi] supports users in real-time streaming of multimedia content and offers services such as chat and voice interaction. Users can add images, stickers, virtual items, and other features provided by the platform to their content, which are then transmitted through the service. It is important to note that the opinions expressed by other users, including those conveyed through virtual gifts, do not represent the platform's stance or values.

       You have a legal right to grant the license specified in these Terms for content published on mobile applications and websites;

       Your content does not infringe the privacy, portrait rights, copyright or other intellectual property rights of any third party;

       You agree to pay all royalties and fees payable to any relevant party for the published content;

6.2. Code of conduct

You agree to comply with all applicable laws and regulations and the conduct norms set forth in this Agreement when using the Application. You shall not use the Application to publish or disseminate any content involving child sexual abuse, sexual exploitation, violence, terrorism, pornography, obscenity, gambling, drugs, discrimination, hate speech, or other illegal or harmful content, including but not limited to:

       Child endangerment: We do not allow any content that sexualizes minors under the age of 18, including but not limited to promoting pedophilia or improper interactions with minors.

       CSAM: Creating and disseminating child sexual abuse material (CSAM) is a heinous crime, and we are committed to combating the distribution of CSAM. In this policy, children refer to anyone under the age of eighteen (18). We adopt a zero-tolerance policy towards child sexual abuse material on our platform, as well as those who create, distribute, seek, or consume CSAM. Any content featuring or depicting children on our platform is strictly prohibited and is considered a serious violation of our terms of service. Any child sexual abuse material we identify or become aware of will be immediately removed. We will report all cases of obvious child sexual abuse material to the police or any other law enforcement agency as required by law and other authorities, and the accounts of those involved in the distribution will be deleted.

       Sexual content and blasphemy: We are committed to providing users with a safe and healthy Internet environment. You may not upload, publish, transmit, perform or store any content that is considered sexual or blasphemous, including pornographic content or anything intended to satisfy sexual content.

       Hate speech: Hate speech is any form of expression by a speaker intended to denigrate, humiliate or incite hatred against a group or class of people on the basis of race, religion, color, sexual identity, gender identity, national origin, disability, nationality or any other characteristic associated with systematic discrimination or marginalization.

       Violence: Describes actual or threatened violence against any person, or encouragement of the illegal or reckless use of a weapon and dangerous substances, or facilitating the purchase of firearms or ammunition.

       Terrorist content: Any message, text, sound, image, code or other data or material that incites or promotes the commission of a terrorist crime, promotes the activities of a terrorist organization, or provides instructions and technology for the commission of a terrorist crime will be defined as terrorist content.

         Bullying and harassment: Bullying and harassment are acts designed to humiliate or intimidate individuals, such as bullying victims of international or religious conflicts, exploiting others' content, including extortion, blackmail, etc., and publishing content to publicly humiliate someone.

You must use the Service in a manner consistent with any and all applicable laws and regulations.

You must not include in the publicly accessible member profile any phone numbers, street addresses, surnames, URLs, or user names from any social platform or email address.

7. Account usage rules

You need to create an account on [ChaloJi] to access and use the services of this application:

       You can create an account using your phone number, Google account or device ID (one-click login). Please note that we will have access to, collect and use information related to these third-party accounts. For more information, see our privacy policy.

       Any account created on [ChaloJi] is your personal account. You must not gift, lend, transfer, or allow anyone else to access or use your account. The account name, user ID, and other identifiers you use on [ChaloJi] remain our property. If your account is terminated or deactivated for any reason, we may disable, reclaim, and reuse these identifiers.

       You are responsible for protecting your account details, including login credentials and any information used under your account. If you believe your password or account has been compromised, you must immediately notify us by email. Unless we receive and confirm your notification of the theft of your account/password, we will consider all activities on your [ChaloJi] account as your own.

Please note that logging in as a guest may result in the loss of your account and any associated benefits (such as prepaid coins). We strongly recommend that you log in with a Google account to avoid any risk of losing your information and coins.

8. User account security

You are responsible for keeping the user name and password set at the time of registration confidential, and you are fully responsible for all operations under this account. If you find that your user name or password has been leaked, used without authorization, or there is any other security breach, please inform us immediately. At the same time, please log out of the account after each use to ensure the security of the account.

9. In-app currency and payments

9.1. Rules for the use of virtual currency

When you purchase or receive in-app virtual currency items (such as diamonds), you do not own them. These coins are used for features like video and text chat. You agree that, based on our rights related to coins and other virtual currencies, we will not be responsible for any issues. We reserve the right to verify your identity and your eligibility to use virtual currency.

Once purchased, virtual currency is considered non-refundable, non-transferable, and non-revocable, even if it expires, is revoked, or ceases circulation. We reserve the right to adjust the price, usage rules, and issuance policies of virtual currency, and may set validity periods, modify terms, or terminate issuance without prior notice. Virtual currency does not have the right to be exchanged for cash or other currencies. If the virtual currency becomes invalid or is lost due to service adjustments, account termination, or other reasons, we will not be responsible for repairs, replacements, refunds, or compensation. You understand and agree that we are not liable for any adjustments or terminations related to virtual currency, and it is recommended to regularly check for updates to the terms.

Any virtual currency purchased or received by a user does not constitute property and is not transferable.

9.2 Payment method and security

You can purchase the paid services of [ChaloJi] through your account on a third-party platform (such as Google Play). The relevant fees will be settled through your third-party account, and the specific billing and payment terms shall be subject to the laws and regulations of the platform. We cannot interfere with its service policies.

Please note that during the payment process, due to network delay or other technical reasons, the system may not be able to synchronize the payment status in real time, resulting in a slight delay in the arrival of virtual currency. If you have any questions or need further explanation, please feel free to contact us by email, and we will assist you to verify and handle it.

10. Terms of use for members

When using this mobile application, website and related services, you must ensure that the registration information submitted is true and valid. At the same time, you must confirm that you are at least 18 years old and that your use of the service complies with the laws and regulations of your region. If we find that the age information is not true, we have the right to delete your account information without notice.

Your membership is for personal use only, and you are prohibited from authorizing the account (including personal data and bound email) to others. You are fully responsible for all activities in the account (including Posting content, email communication and interaction with other members).

If you violate the above terms, your membership will automatically become invalid and the Platform has the right to take corresponding measures.

11. Breach of contract rules and fees

This agreement will remain in effect throughout your use of the application, website, and related services. If you violate the terms of this agreement, we have the right to immediately terminate your membership without prior notice. After the service is terminated, you will not be eligible for a refund of any remaining subscription fees, and certain terms of this agreement, such as liability clauses, will still apply to both parties.

Please note that we may adjust the terms of service and subscription fees according to business needs. By becoming a member, you agree that: in the event of a breach (including failure to pay on time), we have the right to recover the arrears and terminate your membership.

In addition, standard usage charges for SMS, or other data charges may apply and may be charged from your wireless service bill or deducted from your prepaid balance.

12. Terms of acceptance and use of the Agreement

If you cannot understand or accept the terms of this agreement, please immediately stop using the services related to [ChaloJi], including uninstalling the application, ceasing account registration, and stopping functional operations. By using the service, including but not limited to completing registration, using functions, or accepting services, you will be deemed to have fully understood and agreed to all the terms of this agreement, and voluntarily agree to be bound by its terms.

13. Customer service and after-sales support

We are always committed to providing you with quality service support through our professional customer service team. When communicating with customer service staff, please keep civilized and polite, and strictly prohibit the following improper behaviors:

       Use abusive, obscene or profane language

       Publishing offensive, threatening or harassing speech

       Reference to gender or racial discrimination

       Any other words or deeds that violate social order and good customs

If you are found to have violated the above rules, we reserve the right to terminate your account immediately. We believe that mutual respect is the basis of good communication and look forward to building a harmonious service environment with you.

14. Compensation for service support

You agree to indemnify and hold harmless the Services, its subsidiaries, affiliates, officers, agents, and other partners and employees from any loss, liability, claim, or demand arising from your breach of this Agreement in using the Services by any third party, including reasonable attorney's fees.

15. Interact with others

We always advocate for an interactive environment that respects civilized users, but we do not assume responsibility for users' actions, both inside and outside the service. You must exercise caution in all interactions with other users, especially by not providing financial information (such as credit card numbers or bank account details) to others, or making payments through wire transfers, bank transfers, or other means. You are fully responsible for your interactions with other users. Additionally, while the platform has the right to monitor disputes between users, it is not obligated to intervene.

16. Monitoring and compliance

To ensure the platform's security and service quality, we reserve the right to freeze or restrict access to accounts with significant risks. You commit that all information provided during registration (including data submitted through your Google account) is true and accurate, and that you have the legal rights and necessary authorization to post content on the platform. You understand and agree that we have the right to monitor the content you post and may delete any content that violates the agreement or damages the platform's reputation based on our professional judgment. By using this service, you are granting [ChaloJi] the necessary permissions to publish content.

You agree that we, our affiliates and third party partners may place advertisements on the Service. By submitting any feedback or suggestions regarding our services, you agree that we may use and share such feedback for any purpose without paying you for it.

       You understand and agree that, in the following reasonable and necessary circumstances, we have the right to access, preserve and disclose your account information and content:

       To comply with legal and regulatory requirements or cooperate with judicial investigations;

       To ensure the enforcement of the terms of this Agreement;

       To deal with infringement complaints from third parties;

       To respond to your customer service request;

       To safeguard the personal and property safety of the company, users or the public.

This authorization will be exercised only when we reasonably determine that it is necessary and will strictly comply with the requirements of relevant laws and regulations.

17. Spam policy

You commit to strictly adhering to anti-spam regulations when using this service. You are prohibited from engaging in any form of spam activities, including but not limited to uploading, posting, sending emails, transmitting, or otherwise disseminating spam messages, commercial advertisements, and unsolicited commercial solicitation content. If you or your agents are found to be in violation of this policy, we reserve the right to immediately terminate your service access and pursue civil and criminal liabilities.

18. Dispute resolution

You agree that any disputes arising from the terms of this service or the use of the service (including but not limited to disputes arising from your or a third party's access to or use of the service) shall be resolved through arbitration by the Singapore International Arbitration Centre (SIAC), rather than through court litigation (unless the dispute meets the conditions for small claims court and is brought in the name of an individual). Arbitration applies to all claims based on any legal basis or seeking any form of relief (whether under law or equity), and covers all disputes that may arise in the past, present, and future. This agreement is governed by and construed and enforced in accordance with the laws of Singapore.

19. Intellectual property norms

You acknowledge and agree that we own the complete intellectual property rights of this application and all its derivative works, including any future updates or upgrades. Without our explicit written authorization, you may not use our trademarks, product names, logos, domain names, or any other brand features in any form. Any feedback or suggestions you provide will be considered a voluntary contribution, and we reserve the right to use it without compensation and without any obligation.

This application and all its contents, including but not limited to the application code, design, graphics, icons, text, audio, and video, are protected by copyright, trademark, patent, and other intellectual property laws. We are the owner or authorized user of the intellectual property rights of this application and its related content. Without our prior written consent, you may not copy, distribute, modify, display, sell, license, or otherwise use any part of this application and its related content.

We may provide the latest information to this application from time to time. Such updates can be made automatically or manually. Please note that if you do not install the upgrade or new version, the product application may not function properly or at all. We do not guarantee that we will provide any updates for every user of the application, nor do we guarantee that such updates will continue to support your device or system.

20. Limitation of Liability and Disclaimer

1.Under no circumstances will our services be liable for any indirect, consequential, punitive, incidental, special, or exemplary damages to you or any third party, including losses of profits resulting from your use of the mobile application and website or service, even if we have been informed of the potential for such damages. Any liability our services may incur towards you, regardless of the form of litigation, will always be limited to the amount of services you have paid us during your membership period (if applicable).

2.We are not responsible for any inaccurate content published in mobile applications, websites, and services, whether caused by users, members, devices, or programming. We are also not liable for the actions of users (whether online or offline), false registration information, content violations, interaction disputes, account security lapses, or unauthorized access. Due to the nature of the Internet, this application may be affected by various factors, including but not limited to network failures, server malfunctions, hacker attacks, natural disasters, and changes in laws and regulations. These factors can lead to service interruptions, delays, errors, or inability to use the service normally, as well as technical issues such as damage to user devices or data loss due to participating in the service or downloading content. For service issues arising from these force majeure or unforeseeable, unavoidable reasons, we are not responsible. In any case, we are not responsible for personal injury, death, property loss, or service usage outcomes that do not meet expectations, as well as disputes arising from user interactions. This service is provided "as is," without warranties of merchantability, fitness for a particular purpose, or non-infringement, nor do we guarantee specific results from using the service. We are not responsible for third-party advertisements and their content on the platform, nor for the goods or services provided by advertisers.

3. We assure you that we will provide support for [ChaloJi] using reasonable and secure technology.

The risks associated with using this application are borne by you. We do not guarantee that our services will always be safe, reliable, or error-free, nor that they will always run smoothly without interruptions, delays, or imperfections. We do not guarantee that our services will meet your requirements. We do not guarantee that the results obtained from us will be accurate or reliable. We do not guarantee that the quality of products, services, information, materials, or purchased features obtained through our services will meet your expectations. Any materials downloaded or obtained through our services are at your own risk. You will be fully responsible for any damage to your or others' devices, whether direct or indirect, caused by downloading such materials. In certain jurisdictions, such warranties may not be allowed, or limitations or exclusions of liability for incidental or consequential damages may apply. Some limitations on warranties may not apply to you. In such cases, warranties and liabilities will be limited to the maximum extent permitted by applicable law.

21. Feedback and complaints

If you have any dissatisfaction, objection or complaint against other users of [ChaloJi], including any complaint or inquiry regarding the measures taken by you in using [ChaloJi], you should immediately submit such dissatisfaction or complaint to our designated customer service email address and provide us with all necessary information and/or documents so that we can try to resolve the problem.

22. Agreement modification

We reserve the right to modify these Terms of Service at any time. We will notify you in an appropriate manner before any such changes take effect. Please be advised that by continuing to use our services after the terms have been updated, you have fully read, understood and accepted all the revised terms.

23. Additional terms and policies

       In addition to these terms, you must also comply with ChaloJi's Privacy Agreement, which describes how we collect, store and use your personal information when using ChaloJi.

       Some of our services and features may have additional terms specific to their use, which we will update this Agreement and notify you voluntarily. You must comply with such additional terms when using such services and features and such terms.

       We may translate this Agreement into multiple languages. In the event of any discrepancy between the English version of these Terms and any other language version, the English version shall prevail.

24. User agreement confirmation statement

By using this mobile application and website, you are deemed to have accepted the terms of this agreement. Registering as a member further confirms that this agreement constitutes a complete agreement between you and the service provider regarding the use of the application, website, and related services. The service provider's failure to exercise any rights under this agreement does not constitute a waiver of those rights. The chapter titles in the agreement are for ease of reading and do not have legal effect. If you have any questions about this agreement, please contact us promptly.
